Need to know how to get money back from BrickTrainShop returned items.

I'm wondering how to get my money back from BrickTrainShop.com
I've called and emailed several times, and I've had no response. I sent my entire order back about 3 weeks ago. I thought I was getting lego sets, but only got one set and the rest were merely instruction books. Can they be prosecuted for false and misleading advertising? If so, who would do the prosecuting? They show the sets as if you're going to get them vs. just the instruction book.
I'd like to get at least half of my $16 shipping fee back as well...any chance of that? I sent it back UPS; so it should be easy to track to see if it made it back.
Any advice would be most appreciated--I hope I'm not out $71...that was my boys' Christmas gifts money.

If you're not getting any response from the company, you can try filing a complaint with the BBB. It looks like they've been responsive to complaints so far, and have offered to refund returns in cases similar to yours.

Shipping is almost never refunded by retail companies as it covers an expense for a service that is non-returnable and is paid out to a third party, rather than profiting the company ordered from. But you never know what kind of consideration the company might be willing to give you...

Our returns policy is clearly outlined on the stores policies page. We have a very liberal returns policy, simply return your order within 14 days of having received it for a refund. If you do not return the order you will not receive a refund.
